The Mortgage Market in Recovery: Suggestions for a Possible Future

Commissioner Smith with assess the current turmoil in the residential mortgage market and share his suggestions for restructuring the regulation of the market, including the involvement of both state and federal government agencies, as well as the industry and consumers. He proposes that the regulatory framework for the mortgage industry involve a network of state and federal licensing and enforcement agencies, rather than a federal "super-regulator". The Commissioner also urges capital market firms to take and active role in the setting of industry standards for underwriting and originator qualification as a compliment to the actions of government. In addition, he suggests that a healthier market in the future should involve better choices by consumers, either through personal care in the taking on of debt, or through mandated "default" mortgage products that lead to better choices.
